Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and DSIO, operating as Flow State Instructionals ("Flowstate", "we", "us"). They govern your use of flowstateinstructionals.com, our apps, and everything we sell or make available through them (the "Service"). By creating an account, making a purchase, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Flowstate
You must be at least 18 years old, or at least 13 with a parent or guardian who agrees to these Terms on your behalf and supervises your use. You must provide accurate account information and keep it up to date.
You are responsible for everything that happens under your account. Keep your password private, don't share your login, and tell us immediately at the support address below if you think your account has been compromised.
2. What you're buying
Instructionals are sold as a one-time purchase that grants you a personal, non-exclusive, non-transferable, revocable license to stream the purchased content through the Service for as long as the Service operates and your account is in good standing. "Buy once, own forever" describes this ongoing streaming license; it is not a transfer of ownership or copyright in the videos.
A live-event ticket grants the same kind of personal, non-exclusive, non-transferable, revocable license to watch the scheduled live broadcast through the Service, including the event feeds or "mats" made available to viewers. A ticket is access to a stream, not ownership of the event, recording, or any underlying content. You may not resell a ticket, share access, or let another person use your account or playback credentials.
Content is stream-only. You may not download, record, screen-capture, copy, restream, redistribute, resell, share your login to, publicly perform, or create derivative works from any instructional, live feed, or replay, except where downloading is explicitly offered by us. Live playback tokens are short-lived and issued only after checking the signed-in viewer's entitlement; they are for that viewer's use and may not be shared or used to bypass access controls. A breach may result in termination without refund, in addition to any remedies the instructor or we may have under copyright law.
Prices are shown in US dollars and are the total you pay: we do not add sales tax or any other charge at checkout, and any tax we owe on a sale comes out of the price. Discount codes and sales are subject to the conditions shown with them and may be withdrawn at any time.
3. Payments, refunds and chargebacks
Card payments are processed by Authorize.net. We do not store your full card number. By purchasing you authorize the charge shown at checkout.
Because instructionals are digital content that is available immediately, all sales are final once you have begun streaming the content. If you purchased by mistake and have not watched the content, contact us within 14 days and we will refund you in full. We may also refund, at our discretion, where content is materially defective or unavailable.
If an instructor cancels an upcoming or live event through the Service, we attempt a full refund of every active ticket to its original payment method. A refund can fail or be delayed, including while an Authorize.net transaction is unsettled. We flag each failed ticket for manual follow-up; contact us at the support address below if you have not received an expected cancellation refund. Rescheduling an event does not automatically trigger a refund.
If you dispute a charge with your bank instead of contacting us, we may suspend access to the disputed purchase while the dispute is resolved, and we may close accounts that repeatedly file chargebacks on delivered content.
4. Live events, replays and broadcasting
Live-event dates, start times, durations, instructors, feeds and other details may change. An instructor may reschedule an upcoming event, and your existing ticket remains valid for the updated event. Check the event page for the current schedule.
Live events may be recorded. When a feed's recording is successfully processed, it may be attached to the event product as a replay chapter. After the event, the instructor controls whether a ready replay is hidden from new buyers or offered for sale and may set a separate replay price. A ticket holder with an active entitlement can view successfully attached replay chapters even when the instructor hides the replay from new buyers.
A ticket does not guarantee that a replay will be created, successfully processed, available by a particular time, or available permanently. Recordings can fail or be incomplete, and replay access remains subject to the Service continuing to operate and your account remaining in good standing.
Live broadcasts depend on the instructor's equipment and connection, the viewer's device and connection, and third-party infrastructure. Delays, interruptions, reduced quality, missing feeds or recording failures can occur. If a significant technical problem prevents your access, contact support@flowstateinstructionals.com promptly with the event name and details of the problem. We will investigate and may provide support or another remedy where appropriate or required by law, but a technical problem does not by itself guarantee a refund.
Approved instructors may use the Flowstate Live Android app to broadcast with their device's camera and microphone. The app is distributed as an APK directly through our site rather than through an app store. Only install it from the official Flowstate link, review the permissions shown by Android, and keep it updated.
5. Instructors and content
Instructionals are created and owned by independent instructors, not by Flowstate. Instructors are responsible for the accuracy, safety and legality of what they teach. We review content before publication but do not guarantee it. Martial arts training carries a risk of injury: train under qualified supervision, within your abilities, and consult a physician if you have any condition that could be affected by physical activity. You assume all risk arising from applying techniques shown in any instructional.

6. Community: forum, comments, messages and live chat
You can post in the forum, comment on instructionals, send private messages to other members, and participate in live-event chat when eligible. You own what you write, and you grant us a worldwide, royalty-free license to host, display and distribute it as part of operating the Service.
Don't post or send anything that is unlawful, harassing, threatening, hateful, sexually explicit, spam, deceptive, infringing, or that reveals someone's private information. Don't impersonate anyone. We may remove content, restrict features, or terminate accounts that break these rules, and we may review reported private messages to enforce them.
Private messages are private between participants, not end-to-end encrypted; our staff can access them when a message is reported, when required by law, or to keep the Service secure.
Live chat is not private. Messages are visible with your display name to other ticket holders, the instructor and administrators, and remain readable with the event replay unless removed. You may delete your own messages. The instructor and administrators may pin or remove messages, close posting when the event ends, and take other moderation action under these Terms.
7. Intellectual property
The Service, its design, software, trademarks (including the Flow State Instructionals name and triangle mark) and all content not owned by instructors or users are owned by DSIO or its licensors and protected by law. You may not copy, modify, reverse engineer, scrape or build a competing service from them.
If you believe content on the Service infringes your copyright, email dmca@flowstateinstructionals.com with: your contact details, a description of the work, the URL of the infringing material, a statement of good-faith belief, a statement under penalty of perjury that you are authorized to act, and your physical or electronic signature. We respond to valid notices and terminate repeat infringers.
8. Termination
You can close your account at any time from the Account page or by emailing us. We can suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. If we terminate for breach, purchased content and any refunds are forfeited to the extent permitted by law. If we discontinue the Service entirely, we will give reasonable notice and, where feasible, a way to keep access to purchased content.
9. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DSIO, ITS OFFICERS, EMPLOYEES, INSTRUCTORS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY ARISING FROM YOUR TRAINING, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US $100.
11. Indemnity
You agree to defend and indemnify us against claims, damages and expenses (including reasonable legal fees) arising from your content, your misuse of the Service, or your breach of these Terms.
12. Disputes and governing law
These Terms are governed by the laws of the United States and of the state in which DSIO is organized, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at legal@flowstateinstructionals.com and attempt to resolve it informally for 30 days. Any claim must be brought individually, not as a class or representative action, in the state or federal courts located where DSIO is organized, and you consent to their jurisdiction. Small-claims matters may be brought in your local small-claims court.
13. Changes to these Terms
We may update these Terms. When we make material changes we will post the new version here with a new effective date and, for significant changes, notify you by email or in the Service. Continuing to use the Service after the effective date means you accept the updated Terms.
